Hi folks, I asked on here for a bit of help with finding a set of pistons under the ad, evo upgrades. I got a few replies and to those i did get a really good price quote. I called to them to confirm the price and size before ordering and they were correct. I got my mechanic to order the parts and pay for them and they were sent out, and i got them the next day as advised. Problem is the pistons i asked for were 85.5mm and the quote on my thread doesnt say any different and neither does any reply say its for another size of piston. But I was still sent a set of pistons that are stock 85mm and the company that sent them said its my fault. They said they cant refund them cos they are soiled goods, although they are still in the packaging they came in. Also they were opened and shop soiled when i received them. now they have argued that my mechanic is wrong and sent me emails trying to dispute what was said. EVO PARTS.... Why wont you refund me or swap them for the correct parts? Why are you trying to get me to pay more money £375 for a mistake made by you?
No PM's in regards to the comments im sure everything you say to me can be posted here. if you PM me then i will copy and post your reply on this thread.

To those others who have advised me and quoted for parts..... A great big THANK YOU...... you know who you are....
Will be back in touch soon once the build gets started up again as everything is on hold until i get the pistons i need in order to get my bore sized correctly at the engineers....:mad:

I have read all the posts and from what I can tell, the understanding was that you wanted 85.5mm Pistons and that was what you were priced at the time.

I will save you the bother Damian.
I have offered you a possible exchange for 85.5mm but the differance would need to be paid.
Please also bare in mind I HAVE NEVER SOLD YOU ANY PISTONS.
You made an inquiry last month and ive heard nothing back.
I sold the pistons to a company called Far east performance accordingley last week.
As stated before, the confusion is between yourself and mechanic. I have offered you a possible exchange as a good will gesture.

I would haveliked for the matter to be resolved ammicabaly between us, but I it is my opinion that you were intend on having this aired publically from the start.

It reminds me of a recent thread over the road involving "Engine Tuner"
I will post all correspondance between us below, for all at the kangaroo court to see.
It would seem tria/blackmaill by internet is very popular these days.

Just breifly as far as im aware there has been no misunderstanding on our part whats so ever.

We have supplied a set of piston that where specifically mentioned, also an approx bore size was provided at less the 85mm,

The pistons usually sell for £425 plus and are advertised as 85mm piston via the site you seen them on.

Having never spoken to you about them prior to order I find it difficult to understand your comment "Specifics I asked for were 85.5mm"?

I have informed Tariq about the situation and he will get back to you at hs earlieast conveniance.

I mentioned on the email that I will put a complaint on the forum about the parts. I did put on the forum that I was looking for 85.5mm pistons and I was posted a message by your company that those pistons are £325. I also phoned the number left on the forum and checked the piston size and price and also informed Tariq that I will get my mechanic to call and pay for those pistons. Yes in my opinion it came across as being as good as blackmail.

I did put on the forum that I was looking for 85.5mm pistons and I was posted a message by your company that those pistons are £325. The only time I remember is last month when you replied on my thread, I have never qouted you any price for 85.5mm, the pistons I had are advertised on that very board as 85mm for £325.

Also I sent/supplied the pistons to a garage, never once was you ( the customer ) mentioned and as far as I was aware the transaction was completed between us.

It was only a day or 2 later when you called asking for more parts that I was made aware.

I think you may have misunderstood what I said, I stated they are non refundable items due to being shopped soiled, hence why they were cheap to clear at £325 in th first place.

Thats not true, I missed 2 calls literally a few minutes after one another at approx 3.30pm today, I had my passenger reply via text to let your mechanic know im driving and shall call back, which I did and got his answer phone, please ask him to check to verify fact from lies.

Ultimatley your the customer and you are intitled to do as you please as a forum user.

Nothing was said by you regarding any other size of pistons other than what i stated on my thread.
If you log on to the forum go to parts wanted, go onto page 2 and you will see the title of the thread made by me then look at the post you made.
I called you days later regarding the order and clearly stated i would get someone to call back, i did so and my mechanic Pete ordered and paid for the parts. Only reason he paid for them is due to me already paying a deposit to him, towards parts I had already phoned regarding.

I am not blackmailing any one nor am i threatening anyone, just simply pointing out the facts that i will take the action that i see fit to do so as i am so entitled.
As indicated by me that it may result in loss of business on your part due to bad press. That was a warning on the grounds of bad press that people see can be damaging and not a threat, but you are entitled to see it in any way you see fit and you are entitled to your opinion.

I must also point out that any goods that are received by a customer and are not fit for the purpose that they are intended must be exchanged to the value of the original parts and no other money weather higher or lower be exchanged. A refund should be given if the goods are still in the same condition as supplied and in the original packaging. A full refund is more appropriate due to the nature of the situation and due to you trying to charge me more money as to the conversation we had on the phone.
I am not willing to pay any more money for any other parts supplied by you, and under the Sale of Goods Act I dont have too.
The parts I requested are £325 including vat, £10 delivery charge was also added which i accept.
You are trying to get more money out of me for parts that were sent and were not fit for the purpose intended nor where they what i asked for or got quoted for.
The mistake was made by you and therefor will be rectified by you also.
Im asking for the refund to be made as soon as possible and so i can take my business elsewhere as the service and the way i have been treated is not acceptable by any standard.

Im sorry you feel that way.

Had I spoken/sold the pistons to you directly instead of your mechanic then yes I would agree with you and say a mistake has been made on our part.

But as it was Pete who I spoke to and Pete who ordered the pistons not you, I dont see why a refund should be issued on parts that were ordered accordingley.

Never was it mentioned the piston were for yourself, and as far as im concerned I was selling to Fast east performance.

Considering I have answered to your every question, messages and emails, I dont see how my service is below standard, simply because we dont agree on the outcome, but again your intitled to your opinion.

And no im not trying to make any more money from you, but simply offered you another set at cost price i that was possible.

well you could have colour coded the different peoples comments.... that was hard work!!! :whistling:

and after having read the old thread in the wanted section too, i cant see at any point where evo parts stated the pistons were 85.5 only they were new wiseco pistons.

not that i am taking sides etc.... but it does seem that a solution was offered :ninja:

OK, so from the looks of it, the deal was done over the phone between the Mechanic and Evo Parts Ltd.

What size Pistons did the Mechanic request at the time the telephone conversation took place Damian???

From what I can tell so far, you should be in the clear either way buddy in that you will not be out of pocket due to the fact that it was the Mechanic that ordered the Pistons and not you.

With this in mind, you are well within your rights to ask the Mechanic to set things straight as he is responsible for the purchase of all components and not you.

So I did read it right, I would chase up the mechanic, all places do the same they try and get out of losing money its bussiness at the end of the day but ultimately if your persistant you will get what's owed

With the information supplied thus far, it kind of reminds me of what happened to Pauline a short while back where she paid a Mechanic for a Clutch that he ordered but could not fit in the end as it was the wrong Clutch for the car.

In the end, she was left to pay the bill as he claimed his suppliers will not refund any money.

I gave her the Clutch she needed and the cheeky Mechanic asked me if I would do an exchange as I was an authorised Exedy Supplier!!! :confused:

As far as I am concerned, if a Mechanic takes on a supply and fit job then he is responsible for the outcome.

Any and all losses along the way are his problem as he has taken on the responsibility.

Tariq at Evo parts was advised that I would get my mechanic to order the parts that I requested. My mechanic Pete called and advised them that a re-bore was getting done on the car and a supplier should know that the stock piston is 85mm. Pete advised him that the pistons taken out are 84.9mm stock and we needed the oversize 85.5mm.
As to the first thread that Evo parts ltd sent to me on the thread, you would not comment on a request for 85.5mm pistons if you can not send the correct part at the price quoted.
Tariq made a mistake and would not take responsibility for that mistake nor offer a satisfactory option to supply me with what I asked at the price quoted.
I do not intend on airing everything on here at all, but as I advised you I would take further action if I needed too. The results are shown here from what Evo Parts Ltd posted and not by me. If I had the intention to do such a thing then I would have put everything up on my first post.

Id be working on making the mechanic sort it between himself and Evo Parts.
You agreed a price for a job.
Its not your fault he didnt specify the correct parts at time of ordering.

I cant be sure on whos fault it is between evo parts and far east but looking at what has been said I would be putting the blame with far east.
Either way, it shouldnt be your problem.

El my mechanic only went to Evo parts ltd due to me sourcing the parts myself so only did what was asked by me. No mistake was made by the mechanic as I advised Evo parts that he would call and pay for the parts I requested both on the forum and on the first call I made to them to ensure the price and parts were correct.
Even after the pistons were sent I called for the same parts I got quoted by you (also on the forum) and asked about the size of the pistons and I was assured by Tariq they were the correct ones I asked for on the forum.

The way I see it thus far is that it is something that the Mechanic needs to sort out with Tariq as he is the one that has done the actual deal.

It should not affect you in any way buddy as you are paying for a job to be done on a supply and fit basis. At the end of the day, the Mechanic might have gone through your contacts but he is the one that completed the transaction.

On the other hand, even if the Pistons were the wrong size when they were ordered, I can't understand why there is no full refund being offered here. You have stated that they are untouched and as far as I am aware, correct me if I am wrong, they arrived in the last few days or so and the issue was taken up immediately with the supplier.

I feel the need to ask at this point; At any time, between any and all discussion, was it ever mentioned at all that the Pistons are non refundable???

Personally, I would just have accepted them back off you and expected you to cover the cost of returning them. As long as they were in the condition that they were sent out to you/your Mechanic in the first place, I would have replaced them with the correct Pistons once I had had a chance to inspect them upon their return.

By the looks of it, this will drag on for some time.

I do hope however, that this issue is resolved shortly.

Have a word with your Mechanic and get to the bottom of what was discussed between Tarik and himself at the time the Pistons were paid for.

I have spoken to Tarik and he is adamant that the Mechanic asked for Stock Specification and then changed his mind once the Pistons had arrived.

My mechanic has just been on the phone regarding this, Pete explained to Tariq that he was phoning on behalf of a customer, me! And told him that he was phoning about the pistons on the forum told him my name and explained why he needed the 85.5mm pistons. Told him the barrel is scored and it has to be re-bored but needed the pistons first before sending it for the re-bore so the engineers can bore it to the size of the pistons and do the job correctly and not just guess the size.
Nothing at all between me and Tariq or Pete and Tariq were ever the words mentioned non refundable.
It is the suppliers fault rock bottom. I did ask for an exchange and also asked for a refund and I was refused both over the phone, until I sent the emails and posted on here, only then did he tell me he quoted me the wrong price on the forum in the first place, should have been £375 but couldn't change it after it was posted, and again he told me I would have to pay the full £375 price for the oversize and not the £325 price I was quoted on the forum. And the message I left clearly states I asked for 85.5mm and clearly he put on their that he has a set of wisecos for £325.

If he accepted fault instead of blaming other people I would have been happy for a swap and pay the postage one way and not both. But he is being difficult with me and has yet to reply on here or via email that I sent at half 1 today.

As I said earlier, in your initial Thread you did clearly state 85.5mm was the requirement to which the reply came back as £325.

It does boil down to an open and shut case if you look at it that way.

If the Pistons were supplied at the wrong price then that is another reason to take them back of you.

I really do not understand the reasoning behind some Traders out there that do not offer refunds.

They all have varied policies on that particular matter.

I would be happy with him swapping the parts but I dont want to pay another £50 on top of the original price quoted. If that's the case El you offered me pistons at the same price and all other parts could have been ordered from you as well and saved me money.
My mechanic is going to phone Tariq, try and sort something out with him. Let you all know what happens but probs won't be till the morn.
