Shall respond to this in the morning. Seems facts are being lost and replaced with assumption.

El whilst I admire your general admin work on the site, its a little confusing....actually its laughable.

You wrote:
On the other hand, even if the Pistons were the wrong size when they were ordered, I can't understand why there is no full refund being offered here. You have stated that they are untouched and as far as I am aware, correct me if I am wrong, they arrived in the last few days or so and the issue was taken up immediately with the supplier.

I feel the need to ask at this point; At any time, between any and all discussion, was it ever mentioned at all that the Pistons are non refundable???

Personally, I would just have accepted them back off you and expected you to cover the cost of returning them. As long as they were in the condition that they were sent out to you/your Mechanic in the first place, I would have replaced them with the correct Pistons once I had had a chance to inspect them upon their return.

Evo Parts, maybe if you made customers aware of what your policy states before ordering then your customers would know better! Terms and conditions must stay within the guidelines of the law, and no one will ever turn down an exchange because that is the law. My best mate and next door neighbour is a trade and standards environmental officer and I got advice from him yesterday, your terms and conditions should be sent to the customer via the receipt or on a separate sheet. If you do not do this then you are on breach of the law.
I will check my receipt today when I see my mechanic.

To put an end to this.

Damian we have never sold you any parts, our dealings are with far east performance.
Pistons were sold as clearance items ( please see my thread were they have been advertised as such ) at a bargain price of £325, no clearance part is subject to return.

Pistons were supplied after a bore measurement of 84.?? was given. Hence 85mm piston supplied to far east performance. Correct at the time of supply.

I received a call a week later (this tuesday) from Far east performance claiming a disaster had occured and that a hair line marking in one of the bores had been found, hence would need rebore.

Yes a possible mistake may have been made on a thread reply to yourself last month, but had I supplied you the part this would have been rectified before sale or dispatch.

Im well aware of the law and tow the line, I have nothing to hide, unlike some bedroom traders on here who dont pay a penny towards tax revenue amongst other things, yet take the moral high ground when it suits them.

I withdraw my offer of possible exchange as quite frankly you have gone about this the wrong way, going around in circles and its all falling on deaf ears.

For the last time your issue is with Far east performance not Evo parts ltd.

Ive been as transparent as possible for all to see that no wrong doing has occurred on our part.

I shall not be responding to any more emails or threads.

Damian if you would like my full contact details for trading standard to contact me as you stated they would via your last email ( not published here ),pm me for details.

See my thread regarding my car needing a rebore regarding the fact the piston in cylinder one melted, this means it required a re-bore from day one. You knew the facts and still chose to act the way you have done both on the phone and on here. You told me the pistons were ordered in for someone who was doing a re-build and no longer required them. Why tell me if they were surplus to requirements as you put it that they were in fact the correct size 85.5mm and commented on the thread where I asked for those specific sized pistons? My car went in to Far East Performance with all the information required in order for the correct work to get carried out. The damage was very plain to see as there was no head on my car when it was taken to Pete. He was fully aware what needed to be done and he is very much the professional that you are not. Over 20 years doing the job he does specialising in jap cars. It was an easy mistake for you to make regarding the size but why would I ever want a set of stock pistons? And why would you put a message on a thread for stock when I asked for oversized? That is very unprofessional of you to do such a thing.
I hope that everyone on here takes you for what you really are that is a liar and a con man. You say one thing on the phone, try to extort more money from me, Strong words but that is what you are and I have your details and therefor trading standard will be informed of your petty argument. You could have just swapped the part and had done with it but instead you! Not me had to inform me on the phone that you would do nothing about it. Hence why the emails and the thread stared in the first place.

And for everyones information and your own, I called on Tuesday 10/05 to ask about the part and make sure the size was correct, Pete called on Thursday 12/05 and informed you of my thread and ordered the correct part ( not what you said ). On Friday 13/05 the parts were delivered, on Saturday 14th my engine was partially removed, on Monday 16/05, afternoon my engine was fully removed and palleted ready to go to the engineers pistons were measured to ensure all was in order and it wasn't. I was working on Monday 16th and was unable to call Evo parts ltd as I finished at 2130 hrs. Hence the call I made on Tuesday 17th to Tariq to inform him of the error he himself had made. Resulting in what has happened after the phone conversation.
Guys I would stay well clear! And I will not be doing any further business with this individual.

Oh forgot also what Tariq informed me, they dont keep pistons in stock and therefor I have just been given parts that were someone else's mistake.

Quite right Tariq, you can't win them all.....

A little give and take does go a long way though! ;)

There is no confusion and I find nothing laughable when someone is disgruntled, be it a fellow member or a Trader.

As for the reminder, the end result was that I accepted responsibility for the Clutch and offered a full refund before the Thread was posted up and again, whilst the Thread was running. If you read through the whole Thread, you will have noticed that I took a 2 hour drive there and a 2 hour drive back when he had a problem.....

In the end, Jason decided to call it a day and kept the Clutch anyway.

He just wanted to get it off his chest and I understood that completely from the get go.

One complaint in 3 years is not really acceptable to me but it is a hell of a lot better than most Traders out there. I am sure you will agree with that Tariq.

I have not stated that I expect you to take the Pistons back, I have merely stated that if it was me, I would have done so.

I think you have made your point clear on not willing to accept the Pistons back so I guess that wraps it up once and for all.

Jeez, this is a confusing read at the very least.....

I hope you guys can come to some sort of arrangement by where both parties are happy....

Think some points should be taken from this though....

Evo Parts Ltd, Personally, I don't think it would have hurt to take the pistons back and either refund or exchange them, even if this is out of you're guidelines or policies, it would have made for good customer service and I am sure that it would have benefited you more. (IMO of course)

Damojenks, as much as I sympathise with the situation you are now in. In future, maybe order the parts yourself, then supply to your mechanic, because now, you have a 3rd party involved, so what was said and ordered is always going to be up for debate. As Evo Parts Ltd has said, no deal was actually done with yourself, it was with your mechanic.

Like I say, hope you guys get it sorted out.

I called to ensure the part was available I then called Pete gave him the number and he called, explained why he was on the phone and explained the thread and gave my name, Tariq knew exactly who I was and took the payment and sent the wrong part.
It is clear that it's Evo Parts Fault, I called to see if I could get the parts swapped, I was told I would have to pay full price £375 and postage for the replacement. I then asked if anything else can be done and Tariq said no, no refund nothing! I then called Pete and he called Tariq to sort it out and he never answered, instead sent a text saying he would call later. Apparently left a message, Pete tried to call again when I was at the garage and once again no answer. The rest is on here!
I was nice on the phone and was fobed off with excuses, customer service didn't and doesn't exist and neither does business sence if this is what he does.
The parts now will be sold and my business will go else where, cosworth pistons here I come. Bargain price of £260 quid with rings and delivery for 85.5mm pistons. Should be here tomorrow and build is back on, engineers Monday morning!

So turn a frown upside down and something better comes along eventually!!!!

I do think evo parts could have possibly handled it better. But equally it is up to your mechanic to order the correct parts. This should have never come back to you.
It should have been sorted between your mechanic and evo parts.

But glad your build is back on track!

Glad this is finally over and that you are able to sell on the pistons and get the build on track. Think more than anything there is just a valuable lesson to be learned here, leave the mechanics down to the mechanics and the mechanics order the parts. Also forums are a great source of info and there are some very helpful people on them especially this one but the low down is that it is only a forum and if you want proper quotes done on sizes of bores to fit pistons into, take it to a garage have them measure it and order from there, guess work isn't right

I'm sure evo parts ltd has their returns/exchange policy stated somewhere and as long as they do they are fulfilling their part imo the info has to be redily available
